Fence and Gate Rules in Saratoga, Los Gatos, and Los Altos: What You Can Actually Build

Fences and gates seem like simple projects until you start researching your local rules. In Saratoga, Los Gatos, and Los Altos, the regulations governing fence height, materials, and placement are more layered than most homeowners expect—especially on hillside lots, corner properties, and parcels that sit within wildfire hazard zones. This guide breaks down the rules city by city so you can plan your project with confidence.
Los Altos: The Six-Foot General Rule and the Front-Yard Exception
The City of Los Altos sets a general maximum fence height of six feet under Section 14.72.020 of the municipal code. This applies to side and rear yard fences on most standard residential lots. The important exception is the front yard: fences located within the required front yard setback are limited to four feet in height. The same four-foot limit applies within five feet of the exterior side property line of a corner lot.
Permits: Los Altos does not typically require a building permit for fences under six feet that meet zoning requirements. However, any fence that exceeds six feet, is located in a setback, or is part of a larger improvement project may trigger a zoning review or a building permit. The Community Development Department is the right starting point for any fence project that pushes against the limits.
Corner lots in Los Altos also need to account for visibility triangles. At street intersections, fences and landscaping within a defined sight-distance triangle must be kept low enough not to obstruct driver sightlines—typically below three feet in height within that zone.
Saratoga: Height Limits and the Hillside District
Saratoga's zoning code addresses fences in Article 15-29. The standard height limit for fences, walls, and similar structures in residential zones is six feet in rear and side yards. In front yards and exterior side setbacks, the limit drops to three feet for solid fences and four feet for open fences such as wrought iron or split rail.
Saratoga's Hillside Residential district adds another layer. In hillside areas, the Town is particularly concerned about fences that fragment wildlife movement corridors, block scenic views from public roads, or create visual impacts inconsistent with the natural character of the hills. Projects in the hillside district may need to demonstrate that fence placement and materials are consistent with Saratoga's Hillside Design Standards. Wildlife-friendly fence designs—those with ground clearance of at least eighteen inches to allow passage of small animals—are encouraged in hillside areas.
Los Gatos: The Hillside Overlay and View Protection
Los Gatos is one of the more complex fence jurisdictions in Santa Clara County, partly because of how many different overlay zones apply to different parts of town. The standard height limits in Los Gatos residential zones are six feet for side and rear fences and three to four feet for front fences. But properties in the Los Gatos Hillside overlay face additional review under the Town's Hillside Design Standards.
One specific concern in Los Gatos is view obstruction. The Town's design standards include provisions protecting scenic views from public roads and neighboring properties, and a fence or hedge that grows tall enough to block an established view can trigger a complaint and enforcement action. For this reason, solid fences on hillside properties in Los Gatos are often kept lower than the legal maximum, with the view protection secured through planting design rather than enclosure.
The Los Gatos fence code also applies to hedges and walls—any continuous row of vegetation that functions as a fence is subject to the same height limits as a solid structure.
Monte Sereno: Small City, Specific Rules
Monte Sereno maintains its own fence regulations separate from Los Gatos, even though the two cities are adjacent. The City's fence requirements document outlines height limits by yard type, permit triggers, and material restrictions. Fences and walls in Monte Sereno typically follow the same general framework as Saratoga and Los Gatos—six feet maximum in rear and side yards, with lower limits in front yards and setbacks—but the specific numbers and processes should be verified with Monte Sereno's planning department before you start.
Zone 0: Wildfire Ember-Resistant Zones and Fence Materials
The California Board of Forestry and Fire Protection has established Zone 0—a five-foot ember-resistant zone immediately surrounding a structure—as part of updated building standards for properties in Very High Fire Hazard Severity Zones. This zone affects fence and gate materials in a significant way: wood fences attached to or running within five feet of the dwelling are now prohibited in Zone 0 for new construction and major remodels in VHFHSZ areas.
The practical implication for Saratoga hillside properties, Los Gatos hillside areas, and parts of Los Altos Hills: if you are installing a new fence near your home in a fire hazard zone, you may be required to use non-combustible materials—steel, aluminum, concrete, or masonry—within that five-foot perimeter. Beyond Zone 0, wood fences are typically still permitted with appropriate setbacks from vegetation.
Gates: Automation, Setbacks, and Safety
Automated driveway gates are subject to the same setback rules as fences and additional requirements related to gate operation and emergency access. The Santa Clara County Fire Department requires that automated gates serving properties with one or more structures have an emergency access keypad or other approved fire department override. Gates that swing outward toward a public sidewalk or street must be set back far enough that the swing does not encroach on the public right-of-way. For sliding gates on steep driveways, an anti-rollback device or level pad at the gate opening is typically required.
The aesthetic possibilities for gates in this market are extensive—powder-coated steel, Cor-Ten weathering steel, custom wrought iron, wood-and-steel combinations, and laser-cut aluminum panels are all popular in Saratoga, Los Gatos, and Los Altos. The choice of material should be coordinated with the fire zone designation of the property.
